Why Intellectual Property, and Trademarks, Matter

This article was put together by Mark Warzecha, an attorney with one of our Primerus partner firms, Widerman Malek, and focuses on why brand protection is important for your business and how we can help you with your brand protection needs.

As a member of the Primerus network specializing in securing and enforcing intellectual property, I work with many of you and your clients to ensure they are fully protected. One of the benefits in being part of a network is the ability for you to offer legal services to your clients that enhance your relationship with them and provide a specialty service you may not provide.

Protecting the intellectual property portfolio of your client’s business ensures that their trade names, patents, copyrights, or trade secrets are protected from third party infringement, increasing the client’s protectable assets, and enhancing the client’s goodwill and reputation.

Many clients haven’t even thought about their intellectual property and may not have spoken with you about it since that may not be why they hired you in the first place.  If you are looking for a way to build a client’s company brand and want to make sure they are fully protected, contact me and let’s work together to enhance your client’s relationship and provide an additional service to them.

If your firm needs help trademarking or protecting your client’s intellectual property, please contact me I’d love to help.

I’ve put together a list of why having a trademark is incredibly important in case you would like to share with your clients and key contacts.

Why does your business need a trademark? Here are four main reasons:

  1. Brand Protection

A word or logo identifies who you are, what you sell, and helps consumers differentiate your company and is an intangible marketing tool that comes with monetary benefits. A trademark separates your products and services from the rest of the products and services in that field and needs to be safeguarded.

  1. Social Media

Social media today is just as important as having a brick-and-mortar outlet. E-commerce is exploding, and if your clients do not have a trademark to promote and utilize on social media sites, then it may be a large detriment to the business. Don’t wait to file your trademark application.

  1. Reputation

Building your reputation with a positive message in the eyes of the public can give your company a monetary asset to benefit you if, and when, the time comes to sell your company. Leaving the reputation of your company’s identity up for grabs will have serious consequences to your business plans.

  1. Enforcement

Trademark protection prevents others from cashing in on your goodwill and brand reputation. Imitation is the best form of flattery until it starts to affect your bottom line. Obtaining Trademark protection early on, stops you from spending money to build the brand and have someone else benefit from your marketing dollars.
