House Bill 5028 Signed into Law

In a prior post from June 26, 2024, we wrote about Demorest attorney Mark Demorest being featured on Chanel 7 WXYZ regarding House Bill 5028, a new bill impacting homeowners associations and their energy policies across Michigan. 

House Bill 5028, now Public Act 68 of 2024, was signed into law on July 8 by Governor Gretchen Whitmer. A press release from the Executive Office of the Governor highlighted the freedom given to homeowners because of this Act to make energy-saving home improvements to their property. This Act does so by invalidating certain provisions of homeowner association agreements (HOA) that prohibit homeowners from making certain energy-saving improvements to their property. Now that the bill was signed into law, it will take effect 90 days from the date of signature.
