Demorest Law Firm is proud to welcome attorney Joseph Brennan to our team. Joseph brings a focused, thoughtful approach to Michigan real property law, and his background in zoning, land use, and constitutional rights adds real depth to what we can offer clients across the state. This is the kind of addition that makes a firm better, and we are glad he is here.
Joseph’s work centers on helping property owners understand what they can do with their land, whether they already own it or are considering a purchase. That question sounds simple enough, but in practice it runs into a surprisingly tangled web of local ordinances, variance procedures, and permit requirements.
Michigan property owners dealing with real estate law questions often discover that what they planned for a property and what a municipality will allow are two very different things. Joseph brings that hands-on experience to help clients navigate those situations.
Joseph Brennan’s Areas of Focus
Zoning and land use disputes come in a few different forms, and Joseph has worked across most of them. Sometimes a property owner has a clear vision for their land, invests real time and money into planning, and only later finds out that the local zoning code simply does not allow it. Attorney Brennan helps clients in those situations pursue variances and the appropriate permits to make their intended use viable.
Joseph also represents clients who needed to challenge a proposed nearby use that does not fit within the applicable zoning code. Then there are situations where a municipality takes action that oversteps its own rules, or conflicts with Michigan law, or raises questions under the United States Constitution. When that happens, Joseph leads the negotiation process and, when necessary, takes the matter to litigation. He does not shy away from that kind of fight when it is warranted. More precisely, his goal is always to achieve the result the client is looking for.
Beyond his practice of law, Joseph is a Detroiter and is a regular on the Dequindre Cut Greenway, on Belle Isle, and the Manistee River Trail. He also has a deep appreciation for the Upper Peninsula.
A Constitutional Law Background
Joseph’s academic work gives him a layer of perspective that is not common in property law practices. His law review article examined the nuances of Article I, Section 4 of the Michigan Constitution, which protects the free exercise of religion at the state level. The relationship between that provision and the federal First Amendment’s Free Exercise Clause became a contested area of interpretation following significant shifts in U.S. Supreme Court jurisprudence in the 1990s. Joseph’s piece engaged directly with the question of how the Michigan Supreme Court chose to interpret its own constitution in that environment, and whether the reasoning it applied was logically consistent.
He agreed with where the Michigan Supreme Court landed on the outcome. What he proposed was a more coherent analytical path to get there, one that a future court could apply with greater clarity. That kind of thinking, working through not just what the law says but how it ought to be reasoned, is exactly what clients benefit from in complex property and civil rights matters.
Joseph also points to the federalism dimension of that work as something that carries over into his day-to-day practice. The interplay between state and federal law creates real complexity in many cases, including those involving businesses and non-profits. Understanding the full scope of what a client is entitled to under both frameworks is not optional. It is foundational.
